1. General
1.1. By placing an order, the customer acknowledges that they have read, understood, and accepted these Terms and Conditions.
1.2. All orders are subject to stock availability and supplier confirmation.
1.3. The seller reserves the right to amend these Terms and Conditions without prior notice.
2. Product Images and Descriptions
2.1. All product images, photographs, illustrations, specifications, dimensions, colours, and descriptions are provided for illustrative purposes only.
2.2. Actual products supplied may vary from images displayed in brochures, advertisements, catalogues, websites, social media posts, or other marketing material.
2.3. The seller shall not be held liable for minor differences in appearance, design, colour, branding, packaging, specifications, or model variations supplied by manufacturers.
3. Pricing and VAT
3.1. All prices displayed are in South African Rand (ZAR).
3.2. The seller is currently not registered as a Value Added Tax (VAT) vendor and therefore cannot charge or issue VAT invoices.
3.3. Prices displayed are the final prices payable by the customer unless otherwise stated.
3.4. Should the seller become VAT registered in future, pricing and invoicing may be adjusted accordingly.
3.5. Prices are subject to change without prior notice due to supplier price increases, exchange rate fluctuations, or other factors beyond the seller's control.
4. Payment Terms
4.1. Full payment is required prior to the release, dispatch, or collection of goods unless otherwise agreed in writing.
4.2. Orders will only be processed once payment has reflected and cleared in the seller's bank account.
4.3. Proof of payment does not constitute confirmation of cleared funds.
5. Stock Availability
5.1. Most products are sourced from suppliers located in Johannesburg, Gauteng.
5.2. While every effort is made to maintain accurate stock information, stock availability cannot be guaranteed. Ask for a quotation to secure availability of stock.
5.3. In the event that a product becomes unavailable after payment has been received, the customer may choose:
- A refund of the amount paid.
6. Delivery
6.1. Delivery timeframes are estimates only and are not guaranteed.
6.2. Standard economy road freight delivery is generally between 3 and 7 working days from dispatch.
6.3. Delivery periods may vary due to supplier delays, courier delays, public holidays, weather conditions, strikes, remote delivery locations, or circumstances beyond the seller's control.
6.4. The seller shall not be liable for any losses, damages, or consequential costs arising from delayed deliveries.
6.5. Risk in the goods passes to the customer upon delivery.
7. Inspection of Goods
7.1. Customers are encouraged to inspect all goods immediately upon delivery.
7.2. Any shortages, damages, defects, or discrepancies must be reported in writing within 48 hours of delivery.
7.3. Failure to report such issues within the specified period may result in claims being declined.
8. Returns and Warranty
8.1. Returns will only be accepted in accordance with applicable South African consumer protection legislation and supplier policies.
8.2. Products must be returned in their original packaging and condition where applicable.
8.3. Electrical equipment, catering equipment, and machinery must be installed, operated, and maintained according to the manufacturer's instructions.
8.4. Manufacturer warranties apply where provided by the manufacturer.
8.5. The seller acts as a reseller and does not manufacture the products supplied.
9. Limitation of Liability
9.1. Products are used entirely at the customer's own risk.
9.2. The seller shall not be liable for injury, loss, damage, business interruption, loss of profits, or consequential damages arising from the use, misuse, installation, operation, maintenance, or failure of any product supplied.
9.3. Customers are responsible for ensuring that products are suitable for their intended purpose and comply with all applicable health, safety, electrical, gas, and regulatory requirements.
9.4. The seller's maximum liability, if any, shall not exceed the purchase price paid for the product concerned.
10. Installation and Compliance
10.1. Gas appliances must be installed by suitably qualified and certified technicians where required by law.
10.2. Electrical equipment must be installed in accordance with applicable South African electrical regulations.
10.3. The seller accepts no responsibility for damage, injury, or losses resulting from incorrect installation or use.
11. Force Majeure
11.1. The seller shall not be liable for failure or delay in performing obligations due to events beyond reasonable control, including but not limited to natural disasters, strikes, riots, civil unrest, supplier failures, transport disruptions, pandemics, government actions, or power outages.
12. Governing Law
12.1. These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
12.2. Any disputes shall be subject to the jurisdiction of the South African courts.

The warranty document provided below is reproduced for the convenience of customers and remains the intellectual property and responsibility of the supplier issuing such warranty.
By purchasing any product, the customer acknowledges and agrees that:
• Cape Town Advanced Business Solutions is not liable for any warranty claim, repair delay, repair outcome, replacement decision, or warranty dispute.
• Any warranty claim must be lodged directly with the supplier, manufacturer, or their authorised repair agent in accordance with the supplier's warranty procedures.
• Cape Town Advanced Business Solutions shall not be liable for any loss, damage, loss of profits, business interruption, spoilage, consequential damages, or costs arising from equipment failure, warranty claims, or warranty disputes.
• The customer is responsible for reviewing and understanding the supplier's warranty terms before purchasing any product.
The supplier's warranty terms appear below and are subject to change by the supplier without notice.
Third-Party Warranty Clause
All products sold by Cape Town Advanced Business Solutions are subject to the warranty terms and conditions of the relevant supplier and/or manufacturer.
Cape Town Advanced Business Solutions does not offer any independent warranty unless expressly stated in writing.
The customer agrees that all warranty claims, repairs, replacements, and technical support requests shall be directed to the supplier, manufacturer, or their authorised repair agents. We will try and assist you with your warranty claims should the need arise.
Cape Town Advanced Business Solutions shall not be liable for any costs, damages, delays, losses, business interruption, loss of income, spoilage of stock, or consequential damages arising from product defects, warranty claims, or warranty disputes.
Warranty & Returns
This warranty is issued by the Company, suppliers of CATERING, BAKERY, BUTCHERY, REFRIGERATION AND SHOPFITTING EQUIPMENT, PRODUCTS AND APPLIANCES, to the original Purchaser as identified and described on the invoice and shall constitute the only warranty given in respect of that product. The Company warrants to the original purchaser for a period of 12 months from the date of purchase that the product as identified/described by special label and/or invoice is free of defects in material and workmanship under normal use and service subject to the following terms and conditions.
Warranty Terms & Conditions
Bring-In Warranty: Please note that this is a BRING-IN WARRANTY which requires the product/equipment/appliance to be brought back to the store at which it was purchased at the customer's expense. Please contact our repairs department to log the fault prior to bringing in the equipment. Repair or replacement of any part of the product, found by the Company to be defective, shall be at the discretion of the Company. The Company reserves the right to affect such repairs/service through any of its Authorised Repair/Service Agents. Any repair work authorised by the Company may take up to FOURTEEN (14) business days from the date the initial complaint is lodged.
Exclusions from Coverage: This warranty excludes defects caused to the product/equipment/appliance arising from:
Failure to adhere to the instructions given in the user manual/booklet and/or affixed to the product/equipment/appliance.
Incorrect voltages or faults in the electrical power system, power surges, or damage caused by lightning, fire, flood, war, civil disturbance, industrial action, or acts of God.
Misuse or abuse of the product/equipment/appliance, or use of the product/equipment/appliance for a purpose other than that for which it was designed.
Any other cause beyond the reasonable control of the Company.
Note: This will be determined by the Company’s certified technical assessment of the products.
Maintenance Requirements: It is an express condition of this warranty that the purchaser takes due care and attention in the use and maintenance of the products/equipment/appliance by servicing the equipment every 6 months or on a regular basis (dependent on the usage of the equipment) by our Authorised Repairs/Service Agents.
Component Exclusions: The warranty does not apply to and excludes electrical components, fuses, motors, compressors, styli, external plugs, cables, plastic parts, rubbers, glass parts and all moveable parts, gas replacement, bearings, gears, cogs, chains, bulbs, elements, blades, belts, brushes and/or wear and tear components, etc.
Nuisance Calls: Where a repair service is requested under the warranty and no fault or defect is found by the Company or the Authorised Repair/Service Agent, all such costs incurred shall be borne by the purchaser for the nuisance call.
Extended/Repaired Parts: Repairs affected, or parts replaced in terms of the warranty will be subjected to the warranty only for the duration of the balance of the original warranty period relating to the product/equipment/appliance.
Smalls & Utilities: There is no warranty on smalls/utilities/non-electrical articles unless something is obviously defective and is returned within 7 days from purchase.
Second-Hand Goods: This warranty is not applicable to second-hand and/or used products/equipment/appliances.
Refrigeration Specifics: All refrigeration equipment manufactured with refrigeration components (i.e., fridges, display fridges, freezers, cold/freezer rooms, ice making machines, ice cream machines, etc.) must be serviced quarterly by our Authorised Repairs/Service Agents for the duration of the warranty period. The cost of the service will be borne by the customer. Your contact details will be supplied to the Authorised Repair/Service Agents who will contact you regarding servicing of your refrigeration equipment. Failure to timeously service the refrigeration equipment will render the warranty null and void. For all complaints/malfunctions, proof of service must be produced.
Proof of Purchase: The ORIGINAL INVOICE is required to log any warranty or return claims and will serve as proof of purchase. For repair service, it will be essential to produce the invoice to validate the warranty. Failure to do so will render the purchaser liable for all the repair service costs.
Limitation of Liability: The Company is not responsible for the loss/damage to stock/property caused by equipment failure.
Returns Policy
7-Day Return Window: Customers will receive a full refund on products/equipment/appliances returned to the store it was purchased at within 7 days of purchase, provided the products are unused and in their original packaging, and were not damaged by a third-party courier.
Late or Used Returns: All products/equipment/appliances returned after 7 days, used, or without original packaging will be considered second-hand and may be bought back at the Company’s discretion.
